Experienced Drunk Driving Defense Attorney
A DUI conviction will hurt you. There may be jail time and you will lose your license and face higher insurance when you get it back. The criminal record will haunt you, especially if you are arrested for drunk driving in the future.
- First offense DUI — If your blood-alcohol content (BAC) is .08, you will face license suspension for one year, plus fines and Alcohol Safety Action Program (ASAP) classes.
- BAC of .15 or more — Mandatory 5 days in jail, plus the other penalties
- Second DUI — Within five years, automatic 20 days in jail; within 10 years, automatic 10 days in jail
- Third DUI in 10 years — A felony conviction and mandatory 90 days in jail
- "Baby DUI" — If you are under age 21, you can lose your license for six months if your BAC is .02. If your BAC is .08 or more, you face the same penalties as a legal adult.
- Test refusal — If you refused to give a breathalyzer or blood sample, your license is automatically suspended for one year.
- CDL license — If you are truck driver or chauffeur with a commercial driver's license, there is no restricted license. We must go to trial to save your job.
There is no diversion program in Virginia to avoid a conviction for driving under the influence of alcohol or drugs. But I can often get charges reduced to reckless driving or negotiate lesser penalties, and I am not afraid to take your case to trial. I can also represent you in your administrative license suspension to obtain a restricted license to drive to work or school.
