Domestic Violence Is a Serious Charge

It doesn't take much to be arrested for domestic assault — taking a swing at someone, a shoving match, an angry threat heard by the neighbors. If police are called, somebody will be taken away to jail (usually the male).

  • Domestic assault is a Class 1 misdemeanor. If you are convicted, you may have to go back to jail. You will lose the right to possess firearms and may be ordered to pay fines and get counseling.
  • If there was serious injury, it may be charged as malicious wounding, a felony.
  • If you have been convicted before, a third offense of domestic violence is also a felony. That could mean a year or more in jail or prison.

Domestic violence cases are heard in Juvenile and Domestic Violence court (JDR). If the victim wife/girlfriend does not want to press charges, I try to convince the prosecutor to drop the charges. I can also negotiate with the prosecutor for a diversion — no jail time and no conviction if you stay out of trouble for a year.

Restraining Orders and Violations

Temporary restraining orders are issued by the JDR judge. If one is issued against you, you will be kicked out of your home and ordered not to contact the victim or your children. No phone calls, e-mails, text messages. No drive-bys or messages through family members.

In your domestic violence trial, the court will decide whether to continue the restraining order. Violating a "no contact" order, especially threats, stalking or destruction of property, is a civil contempt of court charge — but you can do jail time for it.
