Can We Fight Your DUI?

Challenging a Drunk Driving Arrest

Northern Virginia DUI Defense Attorney

If your blood alcohol was .08 or over, police don't need to prove anything else. But wait. Why did the officer pull you over? How reliable is that breathalyzer reading?

There are viable defenses to a charge of drunk driving. It may be in your best interests to take your case to trial. If you are facing serious jail time, there may be no choice.

I am Christopher Finch, an experienced criminal defense trial lawyer in Fairfax, Virginia. I have represented hundreds of DUI clients in Prince William County, Fairfax County and Arlington County. Contact me immediately at 703-383-1150 before you say anything to police and before you enter a guilty plea.

DUI Defenses

I have had drunk driving charges dismissed or reduced. I have had breathalyzer evidence excluded. I have won DUI cases at trial. Depending on the facts, we may be able to challenge your case too:

  • The traffic stop — Did the officer have a reasonable suspicion to pull you over? If you did not break any traffic laws and there was no good reason for the stop, the case may not hold up in court.
  • Field sobriety tests — There are many explanations for "failing" these roadside tests. Was this the basis for giving you a breathalyzer? Did the officer conduct the tests properly? Does the squad car video show that you "passed" the tests?
  • Breathalyzer — The results of a breath-alcohol test usually stand up in court. I attack the probable cause for giving the breathalyzer in the first place. If you are right on the edge of .08, I can challenge the accuracy of the DUI Intoxilyzer as well.

I will fight to avoid jail, license suspension and other consequences of driving under the influence. I can usually work out a deal to limit the penalties, but if a plea agreement is unacceptable I am prepared to take your case to a jury.
